iHOSPITAL
General Terms and Conditions
This terms and conditions (“terms” or “agreement”) governs the access to or use of iHOSPITAL mobile application (“app” or “application”) by individuals (“user”, “you”, or “your”). iHOSPITAL is a Jordanian limited liability company organized and existing under the laws of the Hashemite Kingdom of Jordan and holding commercial registration number 56427 dated 21/1/2020 (“iHOSPITAL”, “we”, or “us”), and is the sole and exclusive owner of iHOSPITAL mobile application.
iHOSPITAL mobile application is designed to enable you to obtain Home Healthcare consultations and treatment for common medical conditions by facilitating the connection between you and nearby Healthcare Service Providers (“healthcare practitioner”, “healthcare provider” or “healthcare professional”) using the iHOSPITAL mobile application and content, websites, products and services (“services”) related to iHOSPITAL mobile application.
iHOSPITAL IS NOT ENGAGED IN THE PRACTICE OF MEDICINE, DOES NOT PROVIDE MEDICAL SERVICES, AND IS NOT A HEALTHCARE PROVIDER. THE HEALTHCARE PROFESSIONAL WITH WHICH YOU ESTABLISH A TREATMENT RELATIONSHIP IS SOLELY RESPONSIBLE FOR PROVIDING YOU WITH MEDICAL SERVICES. WE ONLY ACT AS A TECHNOLOGY PLATFORM TO CONNECT YOU WITH HEALTHCARE PROFESSIONALS WHO MAY BE INTERESTED IN PROVIDING YOU WITH MEDICAL SERVICES.
Please read the following terms carefully before using iHOSPITAL or its related services.
By accessing or using the Services, you agree to bound by this Agreement as posted and accessible through our Application or website at the time of your access or use and to use the Services in accordance with the terms and conditions of this Agreement, our Privacy Policy and any additional terms and conditions that are referenced herein or that otherwise may apply to specific features of the Services, or to products or services that we make available to you through the Services (all of which are deemed part of this Agreement). If you do not agree to the terms and conditions of use for the Services as set forth in this Agreement, you may not use the Services.
If we need to change the terms of this Agreement in the future, we will post the revised Terms and Conditions of Use through our Application or website and update the “Last Revised” date, below, to reflect the date of the changes. You agree to review these Terms and Conditions of Use each time you use the Services so that you are aware of any modifications made to this Agreement. By continuing to access or use the Services after we post such changes, you agree to the terms of this Agreement, as modified.
Use of the Application and/or Services
To use the Application, you first need to sign up with iHOSPITAL. When signing up, you are obligated to provide us with certain information, such as your name, address, date of birth, credit card information and the name of your primary care provider (if you have one). In the future, we may also require users to provide insurance information. Upon successful completion of the sign up process, we will provide you with a personal account, accessible for you with a password of your choice.
You have to be 18 years of age or older and reside in a jurisdiction in which we offer the Application services. If you reside in a jurisdiction that restricts the use of the Application because of age, or restricts the ability to enter into contracts such as this one due to age, you must abide by such age limits and you must not use the Application. You represent that you are of legal age to enter into a binding contract.
Provided Services
The Application is designed to enable you to send a request for non-emergency medical consultation services to a healthcare professional. The GPS receiver – which should be installed on the mobile device on which you have downloaded the Application – detects your location. The Application identifies to you healthcare professionals who are licensed to use the Application from us and that have engaged us to perform related services. You will be able to select a healthcare professional whom you wish would perform healthcare services to you. After your selection, the Application then sends a message to the professional you selected which asks whether he or she would like to provide you with the requested healthcare services. In the event a healthcare professional agrees to provide you with healthcare services, the Application schedules those services and bills you on behalf of the healthcare professional. We make no representation or warranty to you that any healthcare professional will be available to perform healthcare services.
Online Consult
You may be able to utilize certain Online Consult services through the Services, including but not limited to via iHospital’s Online consult (“Online Consult”, “Video Session”). iHospital is not a healthcare provider, insurance provider, or a prescription fulfillment warehouse. In providing the Video Session, iHospital’s role is limited to making certain telehealth related information available to you and/or facilitate your access to telemedicine services provided by Healthcare Providers. iHospital is not responsible for such Healthcare Providers’ acts or omissions, or for any content of your communications with them. iHospital is independent of the Healthcare Providers, and does not employ or otherwise exercise any control over the services provided by Healthcare Providers, regardless of whether they utilize the iHospital Video Session.
User Responsibilities & Requirements
You represent and warrant that the information you provide to us is accurate and complete. You acknowledge and agree that we are entitled at all times to verify the information provided and to deny your use of the Services at any time for any reason or no reason.
You may only access the Services using authorized means. It is your responsibility to check to ensure you download the correct Application for your device. We are not liable if you do not have a compatible device or if you download the wrong version of the Application for your device.
By accessing or using the Services, you further agree that:
You will only use the Services for your sole, personal use and you will not resell them to a third party;
You will not copy or distribute the Services or other Services content;
You will not upload or transmit any communications or content of any type that infringes or violates any rights of any party;
You will not use the Services for any purpose in violation of local, state or international laws;
You will not use the Services as a means to distribute advertising or other unsolicited material to any third party;
You will not impersonate another person;
You will not post material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful or embarrassing to any other person or entity as determined by us in our sole discretion;
You will comply with all applicable third-party terms of agreement when using the Services (e.g., your wireless data service agreement);
You will ensure that no unauthorized person shall have access to your mobile device or your iHOSPITAL passwords or accounts;
You will promptly notify us in the event your iHOSPITAL passwords or accounts have been compromised;
You will not assign or otherwise transfer your account to any other person or entity;
You will not try to harm the Services or impair the proper operation of the network in any way whatsoever; and
You will provide us with whatever proof of identity we may request.
We reserve the right to immediately terminate your use of the Services should you fail to comply with any of the foregoing rules.
You are free to establish a hypertext link to our Services so long as the link does not state or imply any sponsorship of your website or service by us or by our Services. However, you may not, without our prior written permission, frame or inline link any of the content of our Services, or incorporate into another website or other service any of our material, content or intellectual property.
Payment
There is no charge to register with us or download the Application on your mobile device. You are charged only when you use the Services by scheduling an appointment with a healthcare professional. We reserve the right to introduce a registration fee in the future for downloading the Application. If we decide to introduce such fee, we will inform you accordingly and allow you to either continue or terminate your account.
iHOSPITAL shall, on behalf of the healthcare professional, charge you for the healthcare services provided to you by that healthcare professional. You agree that you will pay for all medical services you receive from the healthcare professional, and that iHOSPITAL may charge your credit card account, as provided by you when registering for the Services including any taxes and late fees, as applicable, that may be accrued by or in connection with your account. You are responsible for the timely payment of all fees and for providing iHOSPITAL with a valid credit card account for payment of all fees at all times. Any payment made is non-refundable.
We use a third-party payment processor to link us to your credit card account. The processing of payments or credits, as applicable, in connection with your use of the Application will be subject to the terms, conditions and privacy policies of the Payment Processor and your credit card issuer in addition to this Agreement. We are not responsible for any errors by the Payment Processor or your credit card issuer. iHOSPITAL will obtain certain transaction details, which we will use solely in accordance with our Privacy Policy.
At present we do not process any insurance claims, nor will the healthcare professionals process claims on your behalf. Although the consultations/treatments you receive from healthcare professionals through the Application may or may not be covered by your insurance, it is solely up to you to contact your health plan, determine whether coverage applies and submit a claim. You are responsible for the full fee (and for paying the fee in advance) regardless of whether you later are able to receive reimbursement from your health plan for part or all of the cost.
Refund
In the event of a ‘Missed Appointment’, a ‘No Show’ or ‘Late Cancellation’, the customer will be charged the full-service cost. A ‘Missed Appointment’, a ‘No Show’ or ‘Late Cancellation’ is defined as missing an appointment, not showing up for an appointment on time, or failing to cancel the appointment 48 hours or more before the scheduled time.
Refunds will not be given if the user is unsatisfied with the healthcare providers' services for any reason.
iHospital will refund the user if the appointment is canceled at least 48 hours before the time of reservation; If the healthcare provider should not show up or cancels the appointment, If the healthcare provider did not attend the Video Session. If the Video Session did not commence due to technical difficulties.
Depending on the payment gateways and the user bank, the refunding process could take between a few days to a few weeks.
Intellectual Property Ownership
iHOSPITAL alone (and its licensors, where applicable) shall own all right, title and interest, including all intellectual property rights, in and to the Services and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by you or any other party relating to the Services.
This Agreement does not constitute a sale and does not convey to you any rights of ownership in or related to the Services, or any intellectual property rights owned by iHOSPITAL. iHOSPITAL’s name, logo and the product names and logos associated with the Services are trademarks of iHOSPITAL, its affiliated companies or third parties, and no right of license is granted to use them.
Application License
Subject to your compliance with the terms and conditions of this Agreement, iHOSPITAL grants you a limited, non-exclusive, non-transferable license to download and install a copy of the Application on a mobile device that you own or control and to run such copy of the Application solely for your own personal use.
You shall not (i) license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to any third party the Application in any way; (ii) modify or make derivative works based upon the Application; (iii) reverse engineer or access the Application in order to (a) design or build a competitive product or service, (b) design or build a product using similar ideas, features, functions or graphics of the Application, or (c) copy any ideas, features, functions or graphics of the Application; or (d) launch an automated program or script, including, but not limited to, web spiders, web crawlers, web robots, web ants, web indexers, bots, viruses or worms, or any program which may make multiple server requests per second, or unduly burdens or hinders the operation and/or performance of the Services.
Indemnification
You agree to indemnify and hold harmless iHOSPITAL, iHOSPITAL’s affiliates, and each of its and their respective directors, officers, managers, employees, shareholders, agents, representatives, licensors, successors and assigns from and against any and all losses, expenses, damages and costs, including reasonable attorneys’ fees, that arise out of your use of the Services, violation of this Agreement by you or any other person using your account, or your violation of any rights of another. We reserve the right to control the defense of any claim for which we are entitled to indemnification under this section. In such event, you agree to provide us with such cooperation as is reasonably requested by us.
Modifications to, or Discontinuation of, the Services
We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services, or any portion thereof, with or without notice. You agree that we will not be liable to you or any third party for any modification, suspension or discontinuance of the Services or any portion thereof.
Governing Law; Jurisdiction and Venue
This agreement shall be governed by and construed in accordance with the laws of HASHIMATE KINGDOM OF JORDAN and the courts of HASHIMATE KINGDOM OF JORDAN shall have exclusive jurisdiction and venue over any dispute arising out of or relating to this agreement, and each party hereby consents to the jurisdiction and venue of such courts.

Indemnification

Privacy Policy
• Techenzone company built the iHospital app as a Free to download app. This SERVICE is provided at no cost except for doctors call services and is intended for use as is.
• This page is used to inform visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Service.
• If you choose to use our Service, then you agree to the collection and use of information in relation to this policy. The Personal Information that we collect is used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.
• The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at iHospital unless otherwise defined in this Privacy Policy.
Information Collection and Use
1. For a better experience, while using our Service, we may require you to provide us with certain personally identifiable information, including but not limited to email address. The information that we request will be retained by us and used as described in this privacy policy.
2. The app does use third party services that may collect information used to identify you.
Log Data
1. We want to inform you that whenever you use our Service, in a case of an error in the app we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.
Cookies
1. Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory. This Service does not use these cookies explicitly. However, the app may use third party code and libraries that use cookies to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.
Service Providers
1. We may employ third-party companies and individuals due to the following reasons:
1. To facilitate our Service
2. To provide the Service on our behalf;
3. To perform Service-related services
4. To assist us in analyzing how our Service is used.
2. We want to inform users of this Service that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.
Security
• We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

• This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
Children Privacy
• These Services do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.
Changes to This Privacy Policy
